I / General Conditions

On the website, our prices include VAT 

PAYMENT CHOICE :

Tickets can be purchased  online, the payment can be made by credit card or via a Paypal transfer.
A confirmation email is sent upon receipt of payment.
On site, payment is by credit card or cash.
For companies, payment is made by bank transfer or check within 30 days of the day of the service.

GIFT VOUCHER :

A Gift Voucher purchased is valid for one year from the date of purchase. Each voucher is identified by a unique number. At the end of one year, if the beneficiary of the voucher did not come forward to Le Food Geek, the voucher will be considered as expired. The Food Geek will then consider itself released from its commitment to the recipient.

A gift voucher is neither exchangeable nor refundable.

All the gift voucher edited from the1st of December 2019 to the 31st of December 2020 can be used until the 31st of December 2021. After that date, The Food Geek will then consider itself released from its commitment to the recipient.

CANCELLATION AND RESCHEDULING::

Any reservation paid for a tasting is firm and final. 
If you are unavailable for a tasting, you can either cancel or postpone your tasting. (please make the request by mail via hello@lecheesegeek.com)
Rescheduling request
If the rescheduling request is made more than 10 days before the date of the tasting, you can freely change the date of your tasting according to the available dates.
If the rescheduling request is made between 10 days and 72 hours before the tasting date, you will receive a voucher worth 50% of the order valid for 1 year.
If the rescheduling request is less than 72 hours before the tasting date will not be accepted.


Cancellation request
If the cancellation request is made more than 10 days before the date of the tasting, the amount of the refund corresponds to 100% of the order (minus 3€ cancellation fee per ticket).
If the cancellation request is made between 10 days and 72 hours before the date of the tasting, the amount of the refund corresponds to 50% of the order (minus 3€ cancellation fee per ticket).
If the cancellation request is made less than 72 hours before the tasting date, no refund will be made.

 

In case of unavailability on our part, we will offer you: the rescheduling of the tasting to another date or the full refund of the reservation on the means of payment (card, Paypal account or bank transfer) used at the time of booking. 

 

MINIMUM PARTICIPANTS:

If the number of participants in a tasting is less than 4 people, we reserve the right to cancel the tasting before the event and offer a rescheduling or a full refund of the ticket(s) within 2 working days.

PROTECTION OF MINORS:

In accordance with the legislation, alcohol tasting is prohibited to minors. The recipient therefore agrees to be 18 years old at the date of the order of a tasting service. The Food Geek declines all responsibility in case of non-compliance with the law without the knowledge of the cheese guide, from the recipient.

RIGHT TO IMAGE

The customer understands that The Food Geek reserves the right to take photos or other images or recordings of its events, and the customer agrees that the images or recordings may be used for promotional and / or commercial purposes, or to approve such use by third parties with whom The Food Geek may engage, without any compensation for it. The customer hereby consents to the use of his name, image and / or likeness in relation to the photographic or other images in any territory, by any means and for any purpose, and waives any request for compensation in this regard.


II / Legal notices

Any order for a service on the websites www.lecheesegeek.fr and www.lecheesegeek.com requires prior consultation of these terms and conditions. Accordingly, the consumer acknowledges that he is fully aware that his agreement regarding the content of these terms and conditions requires the handwritten signature of this document at the bottom of the printed order form. The consumer accepts that the validation during the reservation of service provision, reading and acceptance of the general conditions of sale, vaille impression and handwritten signature.

The consumer has the ability to save or edit these terms and conditions, it being specified that both the backup and editing of this document are the sole responsibility of the consumer.

The consumer, prior to his order, declares that the acquisition of these products is not directly related to his professional activity, their acquisition being reserved for personal use on his part.

As a consumer, the customer therefore has specific rights, which would be challenged in the event that the products or services acquired through the website would actually relate to his professional activity.

The Food Geek Online Catalog as part of the website mentions the following information:

2- Presentation of the essential characteristics of the goods and services offered
3- Indication, in Euros, of the price of services
4- Indication of the terms of payment or execution
6- The period of validity of the offer or the price
 

7- All this information is presented in French and English. The consumer declares to have full legal capacity to engage under these terms and conditions.

Article 1: These general conditions express the entirety of the obligations of the parties.

In this sense, the consumer is deemed to accept unconditionally all the provisions of these terms and conditions. No general or specific condition contained in the documents sent or delivered by the consumer will be able to be integrated into the present ones, since these documents would be incompatible with these general conditions.

Article 2: Purpose

These terms and conditions are intended to define the rights and obligations of the parties in connection with the sale of goods and services offered by Le Food Geek to the consumer.

Article 3: Contractual Documents

This contract is formed by the following contractual documents, presented in descending hierarchical order: the present general conditions; purchase order. In case of contradiction between the provisions contained in the documents of different rank, the provisions of the document of higher rank will prevail.

Article 4: Entry into force - duration

These terms and conditions come into force on the date of signing the order form. The present general conditions are concluded for the duration necessary for the supply of the goods and services subscribed, until the expiry of the guarantees due by the Food Geek.

Article 5: Handwritten signature

Only the handwritten signature affixed at the bottom of the order form can validate it.
The electronic signature via the acceptance of the GTC is equivalent to a handwritten signature.

Article 6: Order Confirmation

The contractual information will be confirmed by e-mail.

Article 7: Proof of the transaction

The computerized registers, kept in the computer systems of Le Cheese Geek under reasonable conditions of security, will be considered as the proofs of the communications, the orders and the payments made between the parts. The filing of purchase orders and invoices is done on a reliable and durable support that can be produced as evidence.

Article 8: Product Information

8-a: The Food Geek presents on its websites the products and services for sale with the necessary characteristics which allow to respect the Article L 111-1 of the Code of the consumption, which foresees the possibility for the potential consumer to know before the final order taking the essential characteristics of the products and / or service that he wishes to purchase.

8-b: The offers presented by The Food Geek are only valid while stocks last.

Article 9: Price

Prices are quoted in euros and are valid only on the date of sending the order form by the consumer. The prices take into account the T.V.A applicable on the day of the order and any change of the VAT rate applicable will be automatically reflected on the price of products and services sold online. Payment of the full price must be made when ordering. At no time, the sums paid can not be considered as a deposit or installments.

Article 10: Method of payment

To pay for his order, the consumer has, at his choice, all the payment methods referred to in the order form. The consumer guarantees Le Food Geek that he has the necessary authorizations to use the method of payment chosen by him, during the validation of the order form.

The Food Geek reserves the right to suspend any order management in case of refusal of authorization for payment by credit card from the officially accredited bodies or in case of non-payment. The Food Geek reserves the right to refuse to honor an order from a consumer who has not fully paid or a previous order or with whom a payment dispute is being administered.

The Food Geek reserves the property of goods and services sold until full payment of the price, in principal and accessory. In case of procedure of safeguard, recovery or liquidation of the buyer, the property of goods and services delivered and remained unpaid may be claimed by the seller. The property remains the property of the seller until full payment of their price, it is prohibited to the buyer to dispose of it to resell or transform before payment. These provisions do not prevent the transfer of risks to the buyer upon delivery of the goods sold.

In application of the law n ° 2012-387 the fixed compensation for recovery costs is 40 euros.

Article 11: Force majeure

Neither party will have failed in its contractual obligations, to the extent that their execution will be delayed, hindered or prevented by a fortuitous event or force majeure. Will be considered fortuitous event or force majeure all facts or circumstances irresistible, external parties, unpredictable, inevitable, beyond the control of the parties and can not be prevented by them, despite all efforts reasonably possible.

The party affected by such circumstances will notify the other within 10 business days of becoming aware of it. The two parties will then approach, within one month, unless impossibility due to force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued.

If the case of force majeure has a duration greater than three months, these terms and conditions may be terminated by the injured party. Expressly, are considered as cases of force majeure or fortuitous events, besides those usually retained by the jurisprudence of the French courts and tribunals and in particular the blocking of means of transport or supplies, earthquakes, fires, storms, floods , lightning; the shutdown of telecommunication networks or difficulties specific to telecommunication networks external to customers.

Article 12: Partial validation

If one or more stipulations of the present general conditions are held for invalid or declared such under a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their force and their reach.

Article 13: Non-Waiver

The fact that one of the parties does not claim a breach by the other party of any of the obligations referred to in these terms and conditions can not be construed for the future as a waiver of the obligation in question.

Article 14: Title

In case of difficulty of interpretation between any of the titles appearing at the head of the clauses, and any of the clauses, the titles will be declared non-existent.

Article 15: Applicable law

These general conditions are subject to French law. This is so for the fund rules as for the rules of form. In case of dispute or claim, the consumer will first contact Le Cheese Geek to obtain an amicable solution.

Article 16: Computing and Liberties

The information requested from the consumer is required to process the order and may be communicated to Le Geek's contractual partners involved in the execution of this order.

The consumer can write to The Food Geek whose contact details are within the confidentiality charter contained in the website, to oppose such communication, or to exercise his rights of access, rectification to the information concerning him and contained in the files of Le Food Geek, under the conditions provided by the law of January 6, 1978.

The Food Geek engages with you, visitors and customers of our site, to guarantee the confidentiality of the personal information that you provide. That means :

Article 20: Guarantees

All our products and services benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for by articles 1641 and following of the Civil Code. In case of non-compliance, it can be exchanged or refunded on presentation of supporting documents.

All complaints, requests for exchange or refund must be made by email to hello@lecheesegeek.com within 30 days from the date of order.
